UEP! UEP! UEP!

There has been an unbelievable amount of activity in the UEP case.   We have many documents to post, and please take some time to read them all.   We have : Judge Lindberg’s response to Rod Parker’s petition to overturn her order disqualifying him;  Arizona’s response to Rod Parker; Arizona’s motion to lift the stay to conduct discovery; Arizona’s objection to the removal of Wisan; the Twin Cities’ response to something or other; Hoole’s joinder in request for discovery; and various notices of violation of the stay.

Notably missing is any response or objection from Utah.

As a refresher and a little background, Rod Parker was disqualified as counsel for FLDS and others adverse to the UEP in litigation.  This is because Parker formerly represented the Trust and he is not allowed to now represent parties against his former client.  Parker petitioned the Utah Supreme Court for extraordinary relief and asked that Lindberg’s disqualification order be vacated (overturned).   The Utah Supreme Court did not rule on Parker’s petition, but instead stayed Lindberg’s disqualification order until the matter could be heard.    It has been stayed for over a year, so Parker was able to continue representing FLDS members against the Trust, despite the disqualification order and despite the obvious and impermissible conflict of interest.  (Parker should be sanctioned by his State Bar for such blatant violations of his ethical canons).

Recently, in denying other FLDS requests, the Utah Supreme Court told Parker that he filed the wrong thing and gave him another chance to get it right if he wanted to go forward with his request to vacate Lindberg’s disqualification order.   Apparently Parker has now filed it correctly in the Utah Supreme Court, along with a request that all actions in the UEP case be stayed indefinitely until the FLDS members file enough pleadings in enough different jurisdictions and courts until they stumble upon a sympathetic or oblivious judge who will hear their pleas of persecution and rule in their favor.

PAY ATTENTION:   What we have here is  the FLDS  attempt to  litigate the UEP into insolvency so the FLDS can  point fingers at Wisan and the Government and claim that they wasted all the FLDS assets because they are an unpopular religion.   While the FLDS carry out this form of self-fulfilling persecution, they intend to hamstring the UEP by preventing the Trust from defending itself  or administering the Trust or distributing  assets,   This is not even clever — this is the oldest litigation trick in the book: starve out your opponent because you have more money and more stamina.   Unfortunately it is often an effective device, but not so in this instance because Arizona has the resources and drive to see it through, and I’m betting Wisan isn’t a quitter either.

We will post the documents shortly in multiple posts.   Many are very lengthy with numerous interesting exhibits which bring to light information not previously disclosed.   Keep your eye on Arizona — they’re pulling no punches and putting out some really outstanding pleadings. (Where’s Utah?)

ADDENDUM:   I AM JUST READING THE DOCUMENTS IN THEIR ENTIRETY.   LET ME TELL YOU, THE FIGHT IS ON. ARIZONA IS RAISING ISSUES THAT COULD BLOW OPEN WHAT APPEARS TO BE THE  FLDS CRIMINAL ENTERPRISE .  ARIZONA ALSO BRINGS TO THE FORE POTENTIAL CONVERSION (THEFT) CLAIMS AND OTHER CLAIMS FOR DAMAGES BASED ON THE CITIES’ WRONGFUL TAKING OF WATER BELONGING TO THE TRUST.    GUESS WHO’S RIGHT IN THE MIDDLE OF ALL OF IT?  NONE OTHER THAN WILLIE JESSOP.   STAY TUNED …..

  1. You’re right. The Arizona filing shows a pattern that could unravel a whole bunch of FLDS criminal activity. I wonder if this issue is getting any investigation by parts of Goddard’s office other than the charitable trust division.

  2. Ron — I believe it is getting lots of investigation by RICO types. Word is that the AZ AG’s office just added a few new lawyers to work exclusively on this issue.

  6. Willie Jessop is good at doing Quit Claim deeds! If Arizona really wants to dig, they can find many FLDS LLC’s were put under forgein corporations,, its easier to hide that way. My problem is why did they wait so long to get involved??

  9. So, we see a picture that Warren and Willie as they sold UEP land, not contingous (but nearly) and is sold to buy land – in far away state parcels.

    So it seems then that these other parcels should still belong to the UEP. Unless….. well you guessed it.

    Sounds like Aspen Management was a money laundering scheme much as the TCWW water deal. Willie was involved with both. Whats the rest of the story?

    And then the deal that Warren said CC and Hildale are “Rejected of God”
    as well as the people who stay there yet they are fighting tooth and nail to keep it.

    And now that the Texas AG isnt happy with them, are they going to sell again and move… but where?

    I think every US State has a State Attorney General, this is not something that is going to go away.

  11. The land is in four pieces totaling 1,311 acres and is being offered by Aspen Management Investments in Hildale for $4.6 million. A company Web site refers to the acreage as prime development land.

  12. Did anyone notice Vance Barlow’s name as the Secretary/Treasurer of the TCWW? He took office on March 14, 2006 after he was decertified as a deputy with the CC/Hildale Marshal’s office.

    And, Alvin Barlow joined the BOD for the TCWW, too after Terry Goddard (AZ AG) had the school district put into receivership and cleaned up.

    HMMMM. The FLDS “movers and shakers” who get fired by Arizona seem to end up running the local water company.

    Pity.

  14. God was calling them together for a little come-uppance. Course God waited to raid the Temple till the finishing touches were complete.
